The only evidence against the accused is that two men who were his accomplices, and to procure this evidence, intimidation seems to have been used. No steps were taken against the accused for some months after the alleged crime, and moreover the magistrate has reported that the witnesses gave their evidence in an untrustworthy manner, and that intimidation has been used to procure evidence, if not to prevent the attendance of the witnesses for the accused, and that therefore the accused was, under the circumstances, much prejudiced in his defence.
